Eyewitness testimony is highly fallible, but still holds its probative value in trial. It’s also the reason why the Innocence Project exists; our recollection is unreliable and malleable. How did that person see a gun, but in all actuality, it was a different object? Uncertainty of an event’s exact details, will always be the cornerstone of our lives, as we recall our pasts. We’ll never be able to rewind and watch the incident, but rewinding our memory won’t help either.
